Taiwanese IP Office: Comments On Amendment of Trademark Act Welcome Until End Of March

After the Taiwan Intellectual Property Office (TIPO) announced revisions to the current Trademark Act in May 2007, the office is now presenting a amended version of the draft. It has been published on TIPO’s website Trademark Act Amendment Forum and the TIPO encourages the public to make comments on the draft until the end of the month. TIPO will compile the opinions regarding the draft, present a further amendment and again hold a public hearing to collect more comments.

The Trademark Act was last amended in June 2003. After finishing the public hearings, the TIPO will submit the draft to the Executive Yuan for its review. If the Executive Yuan agrees with the amendments, the Legislative Yuan has to approve of the draft for it to come into force.

The draft amendment proposes several adjustments, e.g. as a broader definition of trademarks (which will include the protection of scents), easier ways for the registration of collective marks and some amendments regarding certification marks.
