Taiwanese IP Office: Comments On Amendment of Trademark Act Welcome Until End Of March

After the Taiwan Intellectual Property Office (TIPO) announced revisions to the current Trademark Act in May 2007, the office is now presenting a amended version of the draft. It has been published on TIPO’s website Trademark Act Amendment Forum and the TIPO encourages the public to make comments on the draft until the end of the month. TIPO will compile the opinions regarding the draft, present a further amendment and again hold a public hearing to collect more comments.

The Trademark Act was last amended in June 2003. After finishing the public hearings, the TIPO will submit the draft to the Executive Yuan for its review. If the Executive Yuan agrees with the amendments, the Legislative Yuan has to approve of the draft for it to come into force.

The draft amendment proposes several adjustments, e.g. as a broader definition of trademarks (which will include the protection of scents), easier ways for the registration of collective marks and some amendments regarding certification marks.

Japan Customs: Fujitsu Achieves Suspension Of Imports Of Infringing Products

The Japanese company Fujitsu Limited announced last week that Japan Customs granted an injunction against imports of memories and memory modules due to infringement of patent rights owned by Fujitsu. The memory modules were produced by Nanya Technology Corporation Japan, a subsidiary of Nanya Technology Corporation of Taiwan and infringe Fujitsu patent rights.

Background of the suspension is a decision of the Tokyo District Court, ruling that memory modules sold by Nanya Technology Corporation Japan do in fact infringe Fujitsu patents. The court granted an injunction against future import and sales of the infringing products, as well as compensation for past infringements.

TIPO: 2007 April-June Quarterly Report On Taiwan`s Trademarks

The Taiwanese Intellectual Property Office (TIPO) has just published the April-June statistic quarterly report of patents, trademarks and copyrights. The report reveal a slight decline in the number of trademark applications and registrations in Taiwan, compared with the numbers in the April-June period of 2006.

31,145 trademark appllications were filed from April to June 2007, 23,900 of which were filed by residents and 7,245 by non-residents. In comparison with the second quarter of 2006 (34,279 applications, 27,078 by residents, 7,201 by non-residents), the number of foreign trademark applications increased, while the number of applications by residents has been declining.

The number of new trademark registrations shows the same trend with 25,081 registrations compared to 27,431 in the same period in 2006. 19,135 trademarks were registered for residents while 5,946 trademarks were newly registered for non-residents. In 2006, the numbers were 20,839 and 6,592 respectively, showing an equal decline in the number of resident and non-resident registrants.

Taiwan: TIPO To Strengthen Awareness of Internet-Related Piracy

In addition to TIPO`s latest measures to strengthen public awareness of internet-related copyright issues earlier this year, TIPO recently met with rights holders groups and the IPR Police to discuss internet sales methods and legal processes around pirated media.

TIPO Publishes Latest IP Statistics

The Taiwanese Intellectual Property Office (TIPO) published the statistic data of patents, trademarks and copyrights in April 2007. The number of trademark applications in Taiwan constituted 5,265 in January 2007, among which 1,288 applications were filed by non-residents and 3,977 by residents.

The number of new trademark registrations was 4,646. 3,478 trademarks were registered for residents while 1,168 trademarks were newly registered for non-residents.
