Euro Printing Protection Patent: French Invalidation Decision Delayed

There is an ongoing patent dispute between the European Central Bank and Document Security Systems, Inc., around the question whether the Euro bills currently in circulation are infringing on a DSS patent on a method for producing nonreplicable documents (patent EP0455750). The ECB is trying to have the patent invalidated in numerous jurisdictions throughout Europe, as a reaction to an infringment action brought before the European Court of First Instance by DSS. The ECB’s invalidation action was successful in the UK and failed in Germany, the next decision was to be handed down by the Tribunal de Grande Instance of Paris on September 12.

According to a press release by Document Security Systems, the decision has been delayed for the second time and is now planned for November 14, 2007.

Patent auf Euro-Kopierschutz: Entscheidung in Frankreich vertagt

Vor verschiedenen Gerichten Europas spielt sich zur Zeit ein Patentstreit zwischen der Europäischen Zentralbank und der Firma Document Security Systems, Inc. (DSS) um die Frage ab, ob die in Umlauf befindlichen Euro-Geldscheine unter Verletzung eines DSS-Patents auf fälschungssichere Dokumente hergestellt werden (Patent EP0455750). Als Antwort auf eine Verletzungsklage der Firma DSS vor dem europäische Gericht erster Instanz versucht die europäische Zentralbank in verschiedenen europäischen Jurisdiktionen die Nichtigkeit des fraglichen Patents feststellen zu lassen. Nach einem Sieg in Großbritannien und einer Niederlage vor dem BPatG stand als nächstes eine Entscheidung des Pariser Tribunal de Grande Instance an, ursprünglich geplant für den 12. September.

Einer Presseerklärung von Document Security Systems zufolge ist diese Entscheidung nun zum zweiten Mal vertagt worden. Als neuer Entscheidungstermin wurde der 14. November angesetzt.

BPatG: EZB scheitert mit Klage gegen Patent auf Euro-Kopierschutz

Wie IPKat berichtet, hat das BPatG vor einigen Tagen die Entscheidung über die Nichtigkeitsklage der Europäischen Zentralbank gegen ein Patent der Firma Document Security Systems (DSS) veröffentlicht. Das Patent beschreibt eine Methode zum Gelddrucken — bzw. zum Erstellen von Dokumenten, die nicht mit herkömmlichen Fotokopiermethoden im Abtastverfahren reproduziert werden können.

ECB Fails to Invalidate DSS “Money Printing Patent” at Federal Patent Court

As reported by IPKat, the German Bundespatentgericht (Federal Patent Court) has recently published its decision on the validity of a patent held by Document Security Systems for a method of printing money — or rather, a method for printing documents in a way wich makes it impossible to reproduce them with the help of devices using optical scanning (photocopiers etc.).
