Nachdem zu Beginn des Jahres von dem japanischen Patentamt eine Senkung der Amtsgebühren für Marken und Patente in Aussicht gestellt worden ware (wir berichteten), wurde die Gebührensenkung nun vom japanischen Gesetzgeber53 beschlossen und am 18. April bekannt gegeben. Ab dem 1. Juni werden die Amtsgebühren für Patente um durchschnittlich 12 Prozent und für Marken durchschnittlich um 43 Prozent gesenkt werden.

After the JPO’s announcement of a planned reduction in fees back in January (we reported), the appropriate amendment of the Japanese Patent Law has now been approved by the Diet and promulgated on April 18. The amended law includes the reduction of patent and trademark-related fees by an average of 12% and 43% respectively and will come into effect on June 1.

2008 — the year of the rat — is already bringing good news for patent and trademark holders and applicants in Japan: Last week, officials of the Japan Patent Office (JPO) announced a reduction of patent and trademark fees for this year. The current official fees are planned to be lowered by an average of 12 percent on the patent side. An even bigger reduction will come into effect for trademark-related fees, which will be lowered around 43 percent. This will affect mainly the trademark renewal fee which are currently at JPY 151,000 per classification (~ EUR 940), every ten years. The JPO wants to encourage the management of small and medium-size enterprises to make full use of intelletual property rights.
It is not yet certain when the new fee system will come to effect, however, it is expected that the respective regulations of the patent and trademark laws will be approved during the current Diet session which runs from January 18 until June 15.

Das Jahr 2008, das Jahr der Ratte, kann gleich zu Jahresbeginn mit einer freudigen Nachricht für Patent- und Markeninhaber in Japan (oder solche, die es noch werden wollen) aufwarten: Das japanische Patentamt wird voraussichtlich bereits in der ersten Jahreshälfte die Amtsgebühren für Marken und Patente senken. Bei den Patenten ist eine durchschnittliche Gebührensenkung von 12 Prozent vorgesehen. Größer ist die Reduzierung bei den Marken, wo die Gebühren um bis zu 43 Prozent fallen sollen. Dies soll sich vor allem bei den Erneuerungsgebühren auswirken, wo bisher für eine zehnjährige Erneuerung JPY 151.000 pro Klasse zu zahlen sind. Ziel der Gebührenkürzung ist es, vor allem für kleinere bis mittlere Unternehmen die Schutzrechtsverwaltung kostengünstiger und damit attraktiver zu gestalten.
Noch steht das Datum, an dem die Gebührenreduzierung in Kraft treten wird, noch nicht fest. Es wird jedoch damit gerechnet, dass die entsprechenden Änderungen in den Patent- und Markengesetzen noch in der nächsten Sitzungsperiode des Parlaments, welche vom 18. Januar bis zum 15. Juni stattfinden wird, von den Abgeordneten beschlossen wird und noch in der ersten Jahreshälfte in Kraft treten kann.
